Common Assault Charges in Texas
There are several different types of criminal assault charges someone can face in the state of Texas. The Texas Penal Code defines several different forms of assault. Each form of assault carries a specific set of punishment ranges.
The forms of assault in Texas include:
First-degree aggravated assault: This is a felony charge and can have anywhere from 5 to 99 years in jail and up to a $10,000 fine. A first degree aggravated assault charge includes when the offender uses a deadly weapon and causes serious bodily injury during a domestic violence incident.
Second-degree aggravated assault: This type of assault is also classified when a person intentionally and knowingly causes physical harm and injury to another or exhibits a deadly weapon during the assault.
Third-degree felony assault: This type of felony assault carries a 2-10 year prison sentence. This can include crimes such as assault-impeding breath/circulation or assault with previous convictions.
Class A assault: This form of assault is a Class A misdemeanor with up to one year in jail and a fine of up to $4,000. Class A assault is defined as when a person intentionally and knowingly causes bodily harm to someone else.
Class C assault: The lowest form of assault in the state of Texas is a Class C misdemeanor. This type of assault is when a person knowingly engages in physical contact with another person when that physical contact is known to be offensive.
Felony Range of Punishment
- Capital Felony – Confinement in prison for life without the possibility of parole or the death penalty.
- 1st Degree Felony – Punishable by a fine not to exceed $10,000; imprisonment for life or for any term of not more than 99 years or less than 5 years.
- 2nd Degree Felony – Punishable by a fine not to exceed $10,000; imprisonment for any term of not more than 20 years or less than 2 years.
- 3rd Degree Felony – Punishable by a fine not to exceed $10,000; imprisonment for any term of not more than 10 years or less than 2 years.
- State Jail Felony – Punishable by a fine not to exceed $10,000; imprisonment for any term of not more than 2 years or less than 180 days.
