- Felonies have a wide range of punishment. Felonies include, but are not limited to, possession of cocaine, aggravated assault, robbery, manslaughter and murder.
- Felony Range of Punishment
- Capital Felony – Confinement in prison for life without the possibility of parole or the death penalty.
- 1st Degree Felony – Punishable by a fine not to exceed $10,000; imprisonment for life or for any term of not more than 99 years or less than 5 years.
- 2nd Degree Felony – Punishable by a fine not to exceed $10,000; imprisonment for any term of not more than 20 years or less than 2 years.
- 3rd Degree Felony – Punishable by a fine not to exceed $10,000; imprisonment for any term of not more than 10 years or less than 2 years.
- State Jail Felony – Punishable by a fine not to exceed $10,000; imprisonment for any term of not more than 2 years or less than 180 days.
- Misdemeanors
- Misdemeanors have a lower range of punishment than felonies, but can still result in harsh punishment. Misdemeanors include, but are not limited to, DWI’s, some drug offenses, theft under $2,500 and resisting arrest.
- Misdemeanor Range of Punishment
- Class A Misdemeanor – Punishable by a fine not to exceed $4,000; confinement in jail for a term not to exceed one year; or both fine and confinement.
- Class B Misdemeanor – Punishable by a fine not to exceed $2,000; confinement in jail for a term not to exceed 180 days; or both fine and confinement.
- Class C Misdemeanor – Punishable by a fine not to exceed $500.
