A person is charged with domestic violence if they cause bodily injury to a person who is member of their family or household or with whom they have a dating relationship. Many people accused of any type of assault are surprised to learn that bodily injury does not have to be shown by bruises, cuts or broken bones in Texas. Simply anything that causes pain constitutes assault, even a slap. Assault family violence is a Class A misdemeanor and is punishable by a fine not to exceed $4,000 and confinement in jail for a term not to exceed one year. Instead of jail time, assault family violence can lead to 2 years of probation. If an individual has been convicted of two previous assault family violence cases, the third case will be prosecuted as a third degree felony punishable by a fine not to exceed $10,000 and imprisonment for any term of not more than 10 years or less than 2 years.
If you are accused of committing assault family violence by impeding the person’s breathing or circulation, (i.e. choking, smothering, grasping the neck) then the case will be prosecuted as a third degree felony punishable by a fine not to exceed $10,000 and imprisonment for any term of not more than 10 years or less than 2 years.
